These Terms and Conditions (“Terms”) apply to your access to and use of slkango.com.au (“Website”) and the services, content, business promotions, advertisements, listings and other features provided by SL Kango (“SL Kango”, “we”, “us” or “our”).

By accessing or using the Website, you agree to these Terms.

If you do not agree with these Terms, you should not use the Website.

1. About SL Kango

SL Kango provides digital media, community information, business promotion, advertising, event promotion, business discovery and related services primarily for the Sri Lankan community in Australia.

SL Kango may publish information about independent businesses, professionals, events, organisations, products and service providers.

Unless expressly stated otherwise, these third parties operate independently from SL Kango.

2. Using Our Website

You agree to use the Website only for lawful purposes.

You must not:

use the Website in breach of applicable laws;
provide false, misleading or fraudulent information;
impersonate another person or organisation;
attempt to gain unauthorised access to the Website or its systems;
introduce viruses, malicious software or harmful code;
interfere with the operation or security of the Website;
scrape, reproduce or systematically extract Website content without permission;

However, business details, prices, promotions, opening hours, event information, availability and other third-party information may change without notice.

Where appropriate, users should confirm important details directly with the relevant business, event organiser or service provider before making a purchase, booking or other decision.

4. Business Listings and Advertisements

SL Kango may publish paid and unpaid:

business listings;
advertisements;
sponsored content;
promotional videos;
social media promotions;
event advertisements; and
other commercial content.

A business, advertiser or organisation submitting content to SL Kango confirms that:

the information supplied is accurate to the best of its knowledge;
it has authority to advertise the relevant business, product, service or event;
the material does not infringe another person’s intellectual property or other rights;
all required licences, permits and approvals relevant to the advertised service are maintained where applicable; and
the advertisement or promotional material complies with applicable Australian laws.

SL Kango may refuse, edit, suspend or remove content that we reasonably consider misleading, unlawful, offensive, inappropriate or inconsistent with our platform.

Payment for advertising does not guarantee a particular number of enquiries, customers, sales, views, leads or other commercial results unless SL Kango has expressly agreed otherwise in writing.

5. Independent Businesses and Service Providers

Businesses, professionals, advertisers and service providers appearing on SL Kango may be independent third parties.

Unless expressly stated otherwise, SL Kango is not the seller or provider of the goods or services offered by those businesses.

A decision to contact, engage, book or purchase from a third-party business is a transaction between you and that third party.

You should make your own enquiries and satisfy yourself about matters relevant to your decision, including where appropriate:

pricing;
qualifications;
licences;
insurance;
availability;
product or service suitability;
cancellation conditions; and
the business’s own terms and policies.

Nothing on the Website should be interpreted as professional legal, financial, migration, medical, investment or other regulated professional advice unless the content is expressly provided by a suitably qualified professional.

6. Sponsored and Promotional Content

Some content published by SL Kango may be sponsored, paid for or created in collaboration with a business or organisation.

The publication or promotion of a business does not necessarily constitute a guarantee or endorsement by SL Kango of every representation, product or service offered by that business.

Users remain responsible for making their own purchasing and service-provider decisions.

7. Advertising and Promotional Services Purchased From SL Kango

Where a business purchases advertising, video, promotional, listing or related services directly from SL Kango, the scope, price, campaign period and deliverables may be set out separately in a quotation, invoice, proposal, booking confirmation or written agreement.

The customer must provide required content, approvals and information within reasonable timeframes.

Delays in providing content or approvals may affect publication or campaign dates.

Unless otherwise agreed, requested changes outside the agreed scope may be subject to additional charges.

8. Payments

Where SL Kango charges for services, prices will be communicated before the relevant service is confirmed.

Unless otherwise stated:

prices are expressed in Australian dollars (AUD);
applicable taxes may be included or added as stated at the time of purchase;
payments must be made using an accepted payment method; and
services may not begin until required payment or deposit arrangements have been satisfied.

Additional payment terms contained in an accepted quote, invoice or service agreement will also apply.

9. Cancellations and Refunds

Cancellation and refund arrangements for advertising, promotional or other paid services may depend on the nature of the service and the stage of work already completed.

Any specific cancellation conditions provided in a quotation, invoice, proposal or booking confirmation will form part of the agreement.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where Australian Consumer Law provides you with a right to a refund, replacement, cancellation, re-supply or another remedy, that right will continue to apply regardless of anything else stated in these Terms.

10. User and Advertiser Content

You may provide photographs, logos, videos, text, advertisements, business information or other material (“Submitted Content”) to SL Kango.

You retain ownership of intellectual property rights you hold in your Submitted Content.

By providing Submitted Content for publication or promotion, you give SL Kango a non-exclusive, worldwide, royalty-free licence for the period reasonably required to:

reproduce;
edit;
format;
publish;
display;
distribute;
promote; and
communicate

that content through the SL Kango Website, social media accounts and other channels for the purposes for which it was provided.

You confirm that you have all rights and permissions necessary to provide the Submitted Content to us.

11. SL Kango Intellectual Property

Unless otherwise stated, the SL Kango name, branding, Website design, graphics, original videos, written content and other materials created by or for SL Kango are owned by or licensed to SL Kango.

You may view and share publicly available content for personal, non-commercial purposes where normal sharing functionality is provided.

You must not copy, reproduce, modify, republish, sell, commercially exploit or distribute SL Kango’s proprietary content without prior permission, except where permitted by law.

12. Copyright Complaints

If you believe material published through SL Kango infringes your copyright or other intellectual property rights, please contact us with sufficient information to identify:

the relevant material;
your rights in that material;
where the allegedly infringing material appears; and
your contact information.

We may remove or restrict access to disputed material while reviewing a complaint where appropriate.

13. Third-Party Websites

The Website and our social media channels may contain links to external websites and platforms.

These third-party sites are not controlled by SL Kango.

We are not responsible for their content, security, privacy practices, availability or terms.

Accessing an external website is at your discretion and will generally be subject to that provider’s own terms and policies.

14. Website Availability

We aim to keep the Website operational but do not guarantee that it will always be available, uninterrupted or error-free.

We may temporarily suspend or change Website functionality for:

technical updates;
operational reasons; or
circumstances outside our reasonable control.

15. Limitation of Liability

To the maximum extent permitted by law, SL Kango is not liable for losses arising solely from:

reliance on inaccurate or outdated information supplied by independent third parties;
decisions made in relation to independent businesses advertised through SL Kango;
the acts or omissions of third-party businesses or service providers;
third-party websites or platforms; or
Website interruptions or technical issues outside our reasonable control.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms is intended to exclude, restrict or modify rights or remedies available under the Australian Consumer Law that cannot legally be excluded.

16. Indemnity

To the extent permitted by law, if you submit or publish content through SL Kango, you are responsible for losses, claims or expenses reasonably incurred by SL Kango as a direct result of your unlawful content, infringement of third-party rights or material breach of these Terms.

This provision does not apply to the extent that a loss was caused or contributed to by SL Kango.

17. Privacy

Our handling of personal information is described in our Privacy Policy.

By using the Website, you acknowledge that information will be handled in accordance with that Privacy Policy and applicable law.

18. Removal of Content or Access

We may remove listings, advertisements, comments, submissions or other content where we reasonably believe that the content:

breaches these Terms;
breaches applicable law;
infringes third-party rights;
contains fraudulent or misleading information;
poses a security risk; or
may cause material harm to SL Kango, its users or third parties.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Website, services or applicable requirements.

The current version will be published on this page together with the date of the latest update.

Your continued use of the Website after updated Terms are published will be subject to the updated Terms, to the extent permitted by law.

20. Governing Law

These Terms are governed by the laws applicable in Victoria, Australia, together with applicable Commonwealth laws.

The parties submit to the jurisdiction of courts and tribunals having jurisdiction in Victoria, subject to any rights that cannot lawfully be excluded.
